These Terms and Conditions govern your use of hamemb.com and your purchase of digital embroidery design files from HAM Embroidery. By using this website or placing an order, you accept these terms.

1. About Us

HAM Embroidery is a proprietorship based in Surat, Gujarat, India, run by Mr. Imtiyaz Shekhani. We create and sell digital machine-embroidery design files.

2. What You Are Buying

Every product on this website is a digital file, not a physical item. A purchase gives you a downloadable archive that may contain EMB, DST, DHP and DHA design files together with a preview image. Nothing is shipped to you physically.

3. Account Registration

You must create an account and be logged in to complete a purchase and to download your files. You are responsible for keeping your login details confidential and for all activity under your account. Please notify us immediately if you suspect unauthorised use.

4. Licence and Permitted Use

When you purchase a design, we grant you a non-exclusive, non-transferable licence to:

• Use the design on your own embroidery machines;
• Stitch the design onto garments and fabrics, including items you sell.

You may not:

• Resell, share, gift, upload or redistribute the design files themselves, in original or modified form;
• Share your account so that others can download designs;
• Claim authorship of our designs or register them as your own intellectual property.

All designs remain the intellectual property of HAM Embroidery. We reserve the right to suspend or terminate accounts that breach this licence, without refund.

5. Pricing and Payment

All prices are shown in Indian Rupees (₹). We may change prices at any time, but a change will never affect an order that has already been paid for. Payment is collected through a secure third-party payment gateway; we do not store your card or banking details.

6. Delivery

Design files are delivered digitally and become available immediately after your payment is confirmed. See our Shipping and Delivery Policy for details.

7. All Sales Are Final

Our products are digital and are delivered instantly. We do not accept returns, and we do not offer
refunds, cancellations or exchanges on any order. Please check the design details on the product page
before purchasing. See our Cancellation and Refund Policy

7a. Lifetime Access to Your Purchases

Designs you have purchased stay in your account permanently. You may re-download them as often as you
need from My Account → Downloads, with no download limit and no expiry date. This
access is personal to your account and may not be shared.

8. Design Files and Compatibility

Each product page lists the stitch count, size and formats included. It is your responsibility to check that the format and size suit your machine before purchasing. Stitch-out results vary with fabric, thread, backing, needle and machine settings, and we cannot guarantee identical results on every setup.

9. Availability

We aim to keep the website available at all times but do not guarantee uninterrupted access. We may suspend the site for maintenance, updates or reasons beyond our control.

10. Limitation of Liability

To the extent permitted by law, our total liability for any claim relating to a purchase is limited to the amount you paid for that purchase. We are not liable for indirect or consequential losses, including loss of profit, material wastage or machine downtime.

11. Governing Law

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts of Surat, Gujarat.

12. Changes to These Terms

We may revise these terms at any time. The version published on this page at the time of your order is the version that applies to it.
